These Terms of Service (“Terms”) govern your use of Variograph (“the Service”), operated by Flight Tech Labs (“we”, “us”, “our”). By accessing or using Variograph, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Variograph is a web-based flight analysis tool that allows pilots to upload paragliding and hang-gliding flight logs (IGC/GPX format), visualise flight paths, review thermal and glide statistics, and export 3D terrain models for 3D printing. The Service is provided free of charge and “as-is”.
You must be at least 13 years old to use the Service. By using Variograph, you represent that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
You agree to use the Service only for lawful purposes. You must not:
You retain full ownership of the flight files you upload. By uploading a file, you grant us a limited, non-exclusive, royalty-free licence to process that file solely for the purpose of providing the Service to you. We do not store your flight files beyond the duration of your session (see our Privacy Policy). You are solely responsible for ensuring you have the right to upload and process any file you submit.
The Variograph platform, including its source code, design, algorithms, and branding, is owned by Flight Tech Labs and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent. The 3D models you generate from your own flight data belong to you.
The Service relies on third-party providers including Supabase (authentication), AWS (terrain elevation data), and Vercel (hosting). Your use of the Service is also subject to those providers’ terms. We are not responsible for the availability or accuracy of third-party data, including terrain elevation tiles.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Variograph is an analysis and visualisation tool for informational purposes only. Flight data, statistics, safety alerts, and 3D terrain models are not certified for use in safety-critical decisions. Never rely solely on Variograph output when making decisions about flying.
To the maximum extent permitted by applicable law, Flight Tech Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim (which is zero for free-tier users).
You agree to indemnify and hold harmless Flight Tech Labs and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms. You may stop using the Service at any time. Sections 5, 7, 8, and 9 survive termination.
We may revise these Terms from time to time. We will update the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users.
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Bursa, Turkey.
